These Terms of Service (“Terms”) govern services provided by By The Bay RV (“Company,” “we,” “us,” or “our”), a mobile RV repair and inspection service operating in the State of Florida.
By scheduling service, signing a work authorization, clicking acceptance online, or submitting payment, you acknowledge that you have read, understood, and agreed to these Terms, including the arbitration provision and limitation of liability.
1. Services Provided
We provide mobile, on-site RV repair, diagnostic, maintenance, and inspection services subject to technician availability, weather conditions, safe site access, and parts availability.
2. Appointments & Site Access
You agree to provide safe, stable, and legal access to the RV, adequate workspace, and disclosure of known hazards. Service call fees may apply if access is not safely available upon arrival.
3. Estimates & Pricing
- Estimates are based on information provided at booking.
- Final charges may vary if additional issues are discovered.
- Additional work requires approval when reasonably possible.
- Diagnostic fees are non-refundable.
4. Payment Terms & Chargeback Protection
Payment Due
Payment is due immediately upon completion of service unless otherwise agreed in writing. By providing payment information, you authorize us to charge the approved amount.
No Improper Chargebacks
You agree not to initiate a chargeback for valid, authorized services without first attempting good-faith resolution.
Chargeback Recovery
If an improper chargeback is initiated, you agree to pay the original invoice amount, processor fees, administrative costs, collection costs, and reasonable attorney’s fees where permitted by law.
5. Cancellations & Rescheduling
24 hours’ notice is required for cancellations. Failure to provide notice may result in cancellation or service call fees.
6. Mobile / On-Site Risk Acknowledgment
You acknowledge that mobile RV service involves inherent risks including electrical systems, propane systems, mechanical components, uneven terrain, and weather hazards. You voluntarily assume risks related to site conditions.
7. Limited Warranty on Labor
We provide a limited workmanship warranty of 90 days covering defects in labor only. This warranty excludes manufacturer defects, misuse, environmental damage, and pre-existing conditions.
8. Inspections Disclaimer
Inspection services are visual and non-invasive unless otherwise agreed. Reports reflect observable conditions at the time of inspection only.
9. No Consequential or Special Damages
To the fullest extent permitted under Florida law, we are not liable for indirect, incidental, or consequential damages including trip interruption, lodging, towing, lost income, or loss of use.
Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.
Nothing in these Terms limits liability for gross negligence or willful misconduct where prohibited by Florida law.
10. Photographic & Video Documentation Consent
You authorize us to photograph or video record the RV condition, VIN numbers, pre-existing damage, repair processes, and completed work for documentation, dispute resolution, and warranty purposes.
11. Florida Lien Rights
To the extent permitted under applicable Florida law, including Chapter 713, Florida Statutes, we reserve all lawful rights to pursue recovery of unpaid amounts, including statutory lien rights where applicable.
12. Force Majeure
We are not liable for delays or failure to perform due to causes beyond our control including hurricanes, severe weather, supply chain shortages, illness, road closures, or government actions.
13. Indemnification
You agree to indemnify and hold harmless the Company from claims arising from unsafe site conditions, misuse of repaired systems, or failure to disclose known hazards.
14. Mandatory Arbitration & Class Action Waiver
Any dispute arising from our services shall be resolved through binding arbitration in the State of Florida under the rules of the American Arbitration Association or a comparable neutral provider.
You waive the right to a jury trial and agree that all claims must be brought individually, not as part of a class action.
Claims eligible for Florida small claims court may be filed there instead of arbitration.
15. Governing Law
These Terms are governed by the laws of the State of Florida. Proceedings shall occur in the county of our principal place of business.
16. Severability
If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms constitute the entire agreement between the parties and supersede all prior communications or representations.
18. Electronic Consent
Electronic signatures, text confirmations, email approvals, and online acceptances are legally binding and equivalent to handwritten signatures.
